Download the terms as PDFThese terms apply to new bookings accepted on or after 11 October 2026. They cover training, consultancy, workflow support and agreed CAD or CNC preparation services, including services for clients in the United States. Please read them before booking.
1 Who supplies the services
The provider is John Bland, trading as JB CAD Training and John Bland CAD. In these terms, "we", "us" and "our" mean that provider. Our business address is 20 Chalford Grange, Fareham, Hampshire, PO15 5QN, United Kingdom. Contact: john@johnblandcad.com. "You" means the person or organisation purchasing the services. A person booking for an organisation must have authority to agree the booking on its behalf.
2 Business clients and consumers
A business client purchases wholly or mainly for trade, business, craft or professional purposes. A consumer purchases wholly or mainly outside those purposes. Your actual circumstances determine your status; describing yourself as a business does not remove rights the law gives you. Sections expressly marked "Business clients only" do not apply to consumers. Mandatory rights under applicable law take priority over conflicting wording throughout these terms.
3 Booking and agreement
Before acceptance, we will provide these terms and a written booking confirmation or quotation setting out the service, scope, price, payment arrangements, dates or delivery timetable and any agreed special conditions. A booking is agreed when you expressly accept those documents and we confirm acceptance in writing. We will retain that confirmation and provide a copy you can save. A meeting invitation, website visit or attendance alone is not a substitute for giving you the terms before agreement.
A signed or expressly accepted project-specific variation takes priority over a conflicting provision here, except that mandatory rights remain protected. Your purchase-order terms do not replace these terms unless we expressly agree to them in writing. Terms are not changed retrospectively by updating the website. Material changes to an existing booking need both parties' agreement, unless required by law.
4 Scope and standard of service
We will carry out the agreed services with reasonable care and skill. Services may include Rhino or Grasshopper tuition, consultancy, technical and workflow guidance, remote assistance, and agreed CAD or CNC file preparation. Teaching examples illustrate methods; they are not automatically approved production files. We do not promise a particular learning outcome, business saving, grant award or commercial result.
Unless a separate written agreement expressly includes an appropriately qualified service, the booking does not include structural engineering, naval architecture, vessel surveying, statutory inspection, safety certification, code-compliance approval or final manufacturing approval. We will not represent ourselves as providing qualifications or regulated approvals we do not hold. This scope definition does not remove a duty imposed by law.
5 Prices and payment
Standard tuition is £200 per hour, with a two-hour minimum booking (£400). Courses or blocks may be booked from 16 hours (£3,200 at that rate). No VAT is currently charged. The accepted quotation fixes your price and any applicable taxes; later published rate changes do not alter an existing agreed booking. Consultancy, preparation work, travel and in-person expenses are quoted separately and are charged only as agreed in advance. Rhino and other third-party licences are not included unless the quotation says otherwise.
Invoices state the currency, due date and payment method. Payment is in GBP unless we agree otherwise. Any conversion or bank charges should be established before you pay; we do not add undisclosed charges. Advance payment is required only where the booking confirmation says so. We may suspend future work for overdue undisputed payment after written notice and a reasonable opportunity to pay. This does not prevent you raising a genuine dispute or exercising a lawful right to withhold payment. We do not guarantee grant funding or make payment conditional on a funding decision unless separately agreed.
6 Rescheduling and cancellation
Please request a session change by email at least 48 hours before its agreed start time. With that notice, a session can be rearranged without a session-change charge, subject to availability. If you cancel, fail to attend or request a change later, we may charge only reasonable, actual loss we cannot recover after taking reasonable steps to fill the slot or reduce the loss. We will explain the calculation. For a missed or cancelled session, this charge cannot exceed its agreed fee. There is no automatic forfeiture of a whole course or block.
If you end a consultancy project or unused training block, we will account for services already supplied at the agreed rate and any separately agreed, unavoidable costs properly incurred. Any deduction for cancelled reserved sessions remains subject to the preceding paragraph. We will refund the unused balance, normally within 14 days of agreeing the account; a shorter mandatory deadline takes priority. No cancellation charge applies because we breached the agreement or where a statutory cancellation right prevents the charge. Section 20 explains applicable consumer cooling-off rights.
If we must cancel, we will offer an agreed replacement date or refund the affected undelivered services. We will not keep payment for work we do not supply. Reasonable adjustments for genuine illness or emergencies can be discussed; this is not a waiver of statutory rights. A block has no automatic expiry unless a specific, reasonable completion period is disclosed and expressly agreed before booking.
7 Your preparation and production responsibilities
You must provide information, measurements and files you are authorised to use, identify their units and limitations, and tell us about intended use, deadlines and unusual risks before work starts. You must disclose material changes. We may need to revise the agreed scope or timetable where information is incomplete or changes; additional fees require prior agreement.
Before cutting, machining, fabrication, installation or commercial reliance, you must independently check the final revision against the actual project. Checks include dimensions and units, orientation, geometry, offsets, seam and pocket allowances, tolerances, materials and stretch assumptions, nesting, labels, cutting and marking layers, machine settings and mounting or structural suitability. Use suitable test pieces, prototypes or fitting checks where appropriate. You remain responsible for your manufacturing and installation decisions; that responsibility does not excuse our failure to exercise reasonable care and skill.
8 Outputs and approval
Any deliverable list, file format, revision allowance and approval procedure must be agreed in the booking. Drafts and examples must not be treated as approved production outputs. We will identify the intended status of supplied files. Approval should identify the exact file or revision and any outstanding checks. If you discover a suspected error, stop affected production where reasonably possible and notify us with the relevant files and revision details.
Your approval is evidence of the checks you made, not a waiver of a valid claim for our own breach or negligence. We are not responsible for an error or loss to the extent caused by incorrect information you supplied, unauthorised changes, use beyond the agreed purpose, or failure to carry out the checks required by section 7. We remain responsible for consequences attributable to our own breach, subject to lawful limitations below. Extra revisions caused by changed instructions require an agreed additional scope and price.
9 Software and workflow limitations
CAD, scanning, photogrammetry, scripts, plugins, cloud services and AI-assisted workflows can contain errors, introduce distortion or become incompatible. We do not guarantee uninterrupted third-party availability or that a workflow will be error-free on every machine. Those limitations do not cancel our agreed obligations or our reasonable-care-and-skill duty. We will identify known material limitations relevant to the agreed work rather than knowingly present unsafe or unverified output as certified.
Maintain appropriate backups, software licences and security, and test workflows on copies before using live production data. Remote access requires your permission; passwords and authentication codes should not be shared with us. We will not intentionally upload confidential project material to an external AI service without first explaining the proposed processing and agreeing an appropriate lawful arrangement. Separate software products, trials and subscriptions require their own licence and purchase terms; this document alone does not activate or govern a paid software subscription.
10 Ownership and permitted use
You retain ownership of your existing files, designs and confidential information. You give us permission to use them only as reasonably needed to deliver the agreed services and administer the booking. Our existing teaching materials, recordings, scripts, templates and other protected content remain ours or their third-party owner's. Any transfer of intellectual property in a commissioned deliverable must be expressly agreed; paying a tuition invoice does not transfer ownership of our reusable teaching tools.
Subject to payment of the agreed undisputed fees, you receive a non-exclusive, worldwide licence to use supplied training materials internally for your own learning and business work. Unless an agreed licence says otherwise, you may use agreed project CAD and CNC deliverables to manufacture the intended project and pass them to your employees or production contractors for that purpose. This is permission to use the deliverable, not a direct contract or certification for a third party. Normal skills and general knowledge you learn may be used freely.
11 Protection of materials
You must not sell or publish our recordings, teaching materials, proprietary scripts or templates, share them outside the permitted users, or use them to reproduce and market our course or a competing copy of our protected material without written permission. This does not restrict rights which cannot lawfully be excluded, independent development or lawful use of unprotected ideas. Third-party software and content remain subject to their own licences. We do not claim ownership of another provider's software or your pre-existing work.
12 Recording and transcription
Teams sessions can be recorded to provide a learning reference and an accurate session record. Before any audio, video or automated transcription starts, we will explain what will be captured, the purpose, recipients and proposed retention or access period, and obtain express agreement from every participant. This applies to US participants as well as UK participants. A booking alone is not recording consent. Newly joining participants must also be informed and agree before recording continues.
You can decline recording without losing the agreed tuition, and ask us to pause it while sensitive material is discussed. We will offer an unrecorded session or agree an alternative arrangement. You must not secretly record or use an automated meeting assistant without our permission and the necessary participant consents. A recording may be shared with its agreed participants for their permitted learning use, not publicly or for marketing without separate permission. We will not promise permanent hosting; any access period is explained before recording. Neither party may use recordings to train AI models without a separate lawful agreement.
13 Confidential information and privacy
Both parties will use reasonable safeguards for non-public project information, trade secrets, credentials and personal data obtained through the services. They will use it for the agreed work and necessary administration or legal purposes, restrict access to people and providers who need it, and not publish it without authority. Information already lawfully public, independently developed, or lawfully received from another source is not confidential under this clause. Legally required disclosures are permitted; notice will be given where lawful and practicable.
Tell us before sharing particularly sensitive material or personal data about other people, so appropriate access and processing arrangements can be agreed. Each party must have authority and a lawful basis for what it shares. If we will process personal data on your behalf as a processor, a suitable data-processing agreement must be agreed where required; these terms are not a substitute for it. A separate privacy notice explains our processing as a controller. Recording consent does not replace other applicable privacy obligations. No absolute guarantee against every security incident is made, but this does not excuse a failure to take required safeguards.
14 Third-party use and safety
You may involve employees and production contractors as permitted by section 10, but must communicate the intended use, revision status and required checks. Advice or files must not be passed off as engineering approval or presented as giving a third party an unrestricted right to rely on our work. Except for rights which the law gives independently, a person who is not a party to the booking has no right to enforce it. A separate reliance arrangement requires our written agreement.
You and your chosen suitably qualified advisers remain responsible for determining applicable vessel, building, workplace, product and installation requirements for the intended location. Tell us if a proposed use is safety-critical. We may decline work outside our competence, unlawful instructions or an unsafe proposed activity. That does not allow us to avoid responsibility for our own agreed work or duties imposed by law.
15 Liability which is not limited
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, wilful misconduct, gross negligence, or any other liability or remedy which applicable law does not allow to be excluded or limited. This applies before every cap, exclusion and indemnity below. In particular, we do not remove a consumer's mandatory rights to reasonable care and skill, services as described or applicable statutory remedies.
16 Business clients only liability limitations
For an independently booked standalone tuition session, our total aggregate liability arising from that session, whether in contract, tort (including ordinary negligence) or otherwise, is limited to the agreed fee paid or payable for that session, subject always to section 15 and any applicable requirement of reasonableness. The cap is not multiplied by the number of claims relating to the same session. It does not reduce separate statutory liabilities that cannot be capped.
For a course, training block, consultancy engagement or project, the cap is the agreed fees paid or payable for the relevant contracted course, block, engagement or project giving rise to the claim. Work is not divided into a single session or invoice where the claim concerns a wider contracted deliverable. An interrelated claim spanning more than one separately booked session is subject to the combined fees for those relevant sessions, without double counting. No fee-based cap applies to free services unless a separate lawful liability arrangement has been agreed.
Subject to section 15, we are not liable to a business client for lost profit, revenue, business opportunity, anticipated savings, goodwill or business interruption, or for indirect or consequential loss. Where enforceable, these named business-loss exclusions apply whether those particular losses are classified as direct or indirect. Direct remedial costs are not automatically treated as consequential loss merely because they involve wasted material or rework; liability for them, where established, remains subject to the applicable cap. Loss attributable to your failure to make the checks in sections 7 and 8 is allocated as described there.
These limitations reflect the agreed scope and fees and are intended to allocate ordinary commercial risk, not to authorise careless work. If the potential exposure exceeds the stated cap, tell us before booking so a different fee, scope and liability arrangement can be discussed. We make no promise that additional insurance or a higher limit is available. An unenforceable limitation will not be relied upon; other lawful provisions remain subject to section 22.
17 Business clients only limited indemnity
You will reimburse our reasonable losses and legal costs from a third-party claim only to the extent directly caused by your knowing or negligent infringement of third-party rights in material you supplied, your unauthorised modification or misrepresentation of our deliverables, or your materially unlawful use of them. This does not cover ordinary authorised manufacture merely because it involves our work. It never covers loss caused by our own breach, negligence, wilful misconduct or matters protected by section 15.
We must promptly notify you of the claim, take reasonable steps to reduce loss, give reasonable information and allow your reasonable participation in its defence. Neither party may make an admission or settlement binding the other without its written agreement, not unreasonably withheld. There is no double recovery of the same loss. This clause does not apply to consumers.
18 Problems complaints and ending work
Tell us promptly about a problem at john@johnblandcad.com, including the booking and relevant file revision. We will investigate and discuss appropriate correction or another remedy. Reporting promptly helps prevent avoidable loss; these terms do not shorten statutory claim periods. A reasonable opportunity to investigate is not a condition which removes your right to a legal remedy.
We may suspend or end work for a material breach, unlawful instructions, serious abusive behaviour or a genuine safety risk. Where a breach can be remedied, we will normally give written reasons and at least seven days to put it right. Immediate suspension is reserved for serious grounds where continuing would be unsafe or unlawful. We will account for work delivered and refund unused advance payments subject only to lawful, explained deductions. You may end the booking for our material breach and retain any applicable refund or damages rights.
19 Events beyond reasonable control
Neither party is responsible for a delay caused by an event genuinely beyond its reasonable control where it takes reasonable steps to reduce the effect and promptly informs the other. This does not excuse failure to take ordinary precautions, make a contingency plan where reasonably necessary, or pay for services already supplied. If the delay materially defeats the booking's purpose, either party may end the affected undelivered work and you will receive a refund for it. Mandatory consumer remedies remain unaffected.
20 Consumers cancellation and remedies
For a consumer service booking covered by UK distance or off-premises cancellation rules, you may cancel without giving a reason within 14 days after the day the contract is made. Email an unambiguous cancellation statement to john@johnblandcad.com; the optional form in section 23 may be used. Send it before the period ends. Other mandatory cancellation rights and any extended period required by law take priority.
We will not begin during that period unless you expressly request it. If you properly request an early start and then cancel, you may owe only the legally permitted proportion for services actually supplied, provided the required information was given. The cancellation right ends on full performance only where the required express request and acknowledgement of that consequence were obtained. We will refund amounts due within 14 days of being informed of cancellation, using the same payment method unless another cost-free method is agreed. No commercial cancellation penalty replaces these rights. Paid digital content requires its own legally compliant consent and information process; a service booking does not automatically waive digital-content rights.
If you are a consumer, we remain responsible for reasonably foreseeable loss caused by our breach or failure to exercise reasonable care and skill, subject to mandatory law. Sections 16 and 17 do not apply to you. Rights to correction, repeat performance, price reduction, refund or other remedies where applicable are not removed. Buying to learn a business skill does not by itself settle whether you are legally a consumer.
21 Governing law and US clients
The parties choose the law of England and Wales to govern the booking and related non-contractual obligations, except where that choice cannot lawfully apply. For business clients, the parties agree that the courts of England and Wales have exclusive jurisdiction, subject to any mandatory restriction on that agreement. This is a contractual choice, not a statement that US laws, tax rules or local courts can never apply.
For consumers, the choice does not deprive you of mandatory protections or court rights in your country or state of habitual residence where applicable. Nothing here waives mandatory US federal or state consumer protections, statutory remedies or legally protected claims. US state requirements can differ; an English choice-of-law clause does not by itself override them. No mandatory arbitration, jury-trial waiver, class-action waiver or waiver of a lawful complaint to a regulator is created by these terms.
International clients must identify their country and, for US clients, state when booking. We will confirm time zone, currency, delivery arrangements and known applicable charges before acceptance. You remain responsible for local production and installation compliance as explained in section 14; we remain responsible for our agreed services. A separate written local addendum may be needed for a particular transaction.
22 General provisions
If a provision is unenforceable, it will not be applied to that extent. The remainder continues only where lawful and capable of operating fairly; this clause does not ask a court to rewrite an unfair provision or make every limitation valid. A failure to enforce a term immediately is not a general waiver. Neither party may transfer the contract so as to reduce the other's rights without agreement, except where the law permits otherwise.
The booking confirmation, quotation, these terms and expressly agreed variations record the agreement. They do not exclude fraud, a statement or promise expressly relied on and incorporated into the booking, or binding pre-contract information and rights protected by law. Ask about any point you do not understand before accepting. An electronic acceptance may be used with appropriate records; where law requires particular electronic-delivery consent, that consent must be obtained separately.
23 Optional cancellation form and separate consents
To: John Bland, trading as JB CAD Training and John Bland CAD, 20 Chalford Grange, Fareham, Hampshire, PO15 5QN, United Kingdom; john@johnblandcad.com.
I give notice that I cancel my contract for the following services: [describe services]. Ordered or agreed on: [date]. Consumer name and address: [details]. Date: [date]. Signature: [only if this form is sent on paper]. You can instead send any clear cancellation statement; this form is not compulsory.
Where applicable, record the following separately, with the booking reference, participant name and date. Do not use pre-ticked choices or combine optional recording consent with required contract acceptance.
Early service start: "I request that the agreed services start during my cancellation period. I understand that if I cancel after work starts I may have to pay the lawful proportion for services supplied, and that I lose the cancellation right once the services are fully performed following my request and acknowledgement."
Recording: "I agree to this session being recorded and transcribed for the learning-reference purposes, recipients and retention or access period explained to me. I understand I can decline recording or ask it to be paused without losing my agreed tuition."
